The State Securities Board (SSB) maintains this Web site as a public service. This policy describes SSB’s privacy and security practices regarding information collected from visitors to the site.

Please note that information collected or maintained by SSB is subject to the provisions of the Texas Public Information Act(Chapter 552, Texas Government Code). With few exceptions, under Section 552.137 the e-mail address of a member of the public that is provided for electronic communication with a state agency is confidential and not subject to disclosure.

The privacy and security policy for the SSB Web site is as follows:

We do not collect any personally identifiable information, such as name, address, phone number or e-mail address, unless you choose to provide such information, for instance, in the form of an online complaint or inquiry.

We do not use cookies or Web bugs to collect information about users who visit our site. We use software and information on logs to count the number of “hits” on our site, to document any unauthorized attempts to access information on the site, and to identify problems users may encounter accessing pages on our site. These processes do not involve the use of personally identifiable information.

The personal information we collect on Web forms is very limited. With rare exceptions (see next paragraph), the SSB forms on our site can only be printed out for completion on paper. Other forms on our Web site are accessed via links to other sites, e.g., FINRA. When any of those forms are completed and submitted electronically, the personal information on them is transmitted directly to other (non-SSB) sites. The SSB is not responsible for the privacy and security practices of other sites to which our site links. We advise you to read the privacy policies of any third-party sites accessed through the SSB site.

Complaints and employment applications can be submitted electronically to SSB. From time to time, a survey form that can be completed electronically may be on the site. The information collected on these forms is used exclusively for the intended purposes, i.e., processing complaints, hiring agency employees, or analyzing survey results. Such information is, however, subject to disclosure under the Texas Public Information Act.

If you file a complaint online, the information you submit will be used by SSB staff to carry out our official duties and to respond to your complaint. The information may also be sent to the person or company that is the subject of your complaint or to other governmental agencies involved in the matter. The information will not be disclosed to third parties, unless (1) we receive an Open Records request that requires us to disclose the information under the Texas Public Information Act or (2) the information is disclosed as part of an authorized law enforcement investigation.

If you send us an electronic mail message with a question or comment that contains personally identifiable information, we will only use the personally identifiable information to respond to your request and to analyze trends. We may redirect your message to another government agency that is in a better position to respond to your question or comment. We will not sell your e-mail address. Except for the purposes of carrying out a lawful investigation or court order, we will not release your e-mail address or any other personally identifiable information unless you affirmatively consent to the release of the information or we are required to release the information in response to an Open Records request.

Our policy is not to collect personally identifiable information from IP (Internet Protocol) logs. In the event of authorized law enforcement investigations, however, and pursuant to any required legal process, information from IP logs and other sources may be used to help identify an individual. Except for such authorized law enforcement purposes, no other attempts are made to identify individual users or their usage habits.

With few exceptions, you are entitled on request to be informed about the information that the SSB has collected about you. Under Sections 552.021 and 552.023 of the Government Code, you are entitled to receive and review the information. Under Section 559.004, Government Code, you are entitled to have SSB correct information about you that is incorrect. Be advised that certain information, such as that gathered in connection with an investigation by the State Securities Board or other law enforcement authorities, is prohibited from release by state law.
